BIG BEAR APPAREL LLC / EFFECTIVE NOVEMBER 6, 2026
Order terms.
These terms apply to quotations and accepted custom-apparel orders supplied by Big Bear Apparel LLC (“Big Bear,” “we,” “us”). Any specific written terms agreed for an order take priority where they expressly vary these terms. Mandatory legal rights remain unaffected.
1. Quotes and acceptance
A website inquiry is a request for information, not an order. Pricing, garments, quantities, decoration, artwork preparation, taxes, delivery charges and any quote expiry are confirmed in the written quote. Orders are accepted only when we confirm acceptance in writing. Customer purchase-order terms do not change our agreement unless we expressly agree in writing.
2. Minimum quantities and full upfront payment
The minimum is 72 pieces per design unless we agree otherwise in writing. All accepted orders must be paid in full, in cleared funds, before we purchase garments or begin production. Payment does not replace the need for written artwork approval. Do not send card details through email or the quote form. Payment instructions will be supplied separately.
3. Garments, sizes and availability
Applicable taxes and delivery charges are stated in the quote or invoice. If you claim a resale or other exemption, provide valid supporting documentation before invoicing. We collect and remit taxes where legally required.
Customers must check the accepted style, color, size breakdown and quantities. Supplier stock can change before garments are secured. We will seek approval before making a material substitution. Manufacturer sizing, dye lots, fabric and construction can vary; supplied size charts and images are guidance, not a guarantee of identical fit across brands.
4. Artwork, proofs and customer approval
Production requires written approval of the final proof and order specifications. Check spelling, names, numbers, colors, dimensions, placement and garment details. We are not responsible for errors present in a proof or specification you approved, except to the extent caused by our failure to follow that approval or required by law. Changes after approval may affect pricing and timing and require written acceptance.
Screen colors are not an exact match to inks, thread or garments. If a precise color or placement tolerance is essential, tell us before accepting the quote so any physical sample, color specification and tolerances can be agreed. Normal process variation does not excuse a material departure from agreed specifications.
5. Rights to artwork and branding
You confirm you own or have permission to reproduce all artwork, logos, names and other material you provide. You grant us the limited right to use that material to quote, prepare and fulfill your order. We may decline unlawful or infringing work. To the extent permitted by law, you agree to cover reasonable third-party claims and costs arising from material you supplied without the required rights, excluding claims caused by our unauthorized alterations or misconduct.
We will obtain permission before using identifiable customer artwork or finished orders in our public marketing. Sending artwork for a quote does not transfer ownership to Big Bear. Any digitizing or preparation deliverables and ownership rights are specified in the quote.
6. Scheduling, delivery and deadlines
Tell us any essential in-hands date before ordering. A requested date is not a guarantee unless expressly accepted in writing. Scheduling depends on cleared payment, written approvals, garment availability and complete order information. We will communicate material delays and follow applicable requirements for revised dates, consent, cancellation and refunds. Nothing in these terms removes rights relating to goods not shipped within an agreed or legally required period.
Delivery and collection arrangements, charges and any specific risk-of-loss terms are confirmed with the order. Please report delivery problems promptly so they can be investigated. We remain responsible for our obligations under the agreement and applicable law.
7. Changes and cancellation
Contact us immediately to request a change or cancellation. We will confirm whether it can be accommodated and any effect on price or schedule before proceeding. For a customer-requested cancellation after acceptance, any deduction from a refund will be limited to reasonable, documented, nonrecoverable costs already incurred and lawful charges disclosed and agreed for the order; we will not retain payment for costs we recover or avoid. Mandatory cancellation and refund rights take priority.
Custom goods made correctly to approved specifications are not returnable simply because you change your mind, selected the wrong approved size or no longer need them. This does not restrict remedies for defective goods, incorrect production, non-delivery or other rights required by law.
8. Inspection, defects and remedies
Inspect goods promptly and contact hello@bigbearapparel.com with your order reference, a description and clear photos of any issue. Reporting within 7 days helps investigation, but is not a waiver of rights that cannot lawfully be limited or of a defect that could not reasonably be discovered then. Keep affected goods and packaging; contact us before returning, altering or distributing disputed items.
Where we are responsible for a material defect or departure from agreed specifications, we will investigate and provide an appropriate repair, replacement, re-performance or refund as required by the circumstances and applicable law. We will not exclude responsibility merely because goods are customized.
9. Customer-supplied garments
Customer-supplied goods require prior written acceptance. We will agree quantities, condition, suitability and any specific risk allocation before production. Decoration can carry a risk of damage; we will not impose an undisclosed spoilage allowance or blanket exclusion. No extra quantities, shortages or substitutions will be charged without agreement.
10. Liability and events outside reasonable control
To the fullest extent permitted by law and where legally enforceable, liability for an affected order is limited to the amount paid for that order, and indirect or consequential business losses are excluded. These limitations do not apply where prohibited, including to fraud, willful misconduct, gross negligence or statutory rights that cannot be excluded. They do not limit any remedy the law requires us to provide.
Events outside reasonable control may affect performance. We will notify you and discuss a revised plan, while preserving all applicable cancellation, shipment-delay and refund rights.
11. Law, disputes and changes
California law governs to the extent permitted by applicable law. Contact us first to seek a practical resolution. Any court proceedings will be brought in an appropriate court with jurisdiction; mandatory venue rules and small-claims rights remain unaffected. These terms do not require arbitration or waive class-action rights. Updated website terms apply prospectively and do not change an accepted order without agreement.
